Timothy W. Fagan seeks reversal of the decision of the United States Court of Appeals for Veterans Claims (“Veterans Court”) affirming the Board of Veterans’ Appeals (“Board’s”) denial of his claim for service connection benefits for bilateral hearing loss. Fagan v. Peake, No. 06-1327, 2008 WL 2130166 (Vet.App. Feb. 29, 2008) (unpublished table decision) (“Veterans Court Decision”).
