MO SCO WITZ, District Judge.
On October 24, 1934, a petition was filed herein by creditors of the Prudence Company, Inc., for .reorganization of the said corporation under section 77B of the Bankruptcy Act (11 USCA § 207). The Superintendent of Banks of the State of New York, who had theretofore taken possession of the assets and property of the said corporation pursuant to the authority vested in him by section 57 of the Banking Law of the^ State of New York, filed an answer controverting the material allegations of the petition and moved to dismiss the same for insufficiency.and lack of…
