Defendant, Francis C. Stefurak, moves for dismissal of the trustee’s complaint on the ground that it fails to state a claim upon which relief can be granted. In essence, the defendant contends that the trustee has no standing to bring an adversary proceeding to set aside the transfer to the defendant of a certain finder’s fee under 11 U.S.C. § 549 asserting that the finder’s fee is not “property of the estate” under 11 U.S.C. § 541.
