—Order, Supreme Court, New York County (Beatrice Shainswit, J.), entered February 24, 1998, which, inter alia, granted defendant’s motion to dismiss the complaint, unanimously modified, on the law, to deny the motion with respect to the cause of action for breach of contract and reinstate that cause of action and to grant the cross-motion to amend the complaint to the extent of permitting plaintiff to assert the first, second, fourth and fifth causes of action of the amended complaint, and otherwise affirmed, without costs.
