*129The parties appear in this court in reverse order from their appearance in the trial court and will be referred to herein by name, or as plaintiff or defendant, as they appeared in the trial court.

The action was brought by the plaintiff to recover $2,302.06 alleged to be owing following the seizure and sale of a truck under the terms of a chattel mortgage. The said mortgage secured an original indebtedness of $3,987.36 and was signed by defendant December 1, 1955, at which time he purchased the truck from the plaintiff for the total purchase price of $4,994.42.
