The issue in this cause is whether T. K. Potter, executor of the will of John H. Potter, deceased, is entitled, under his cross-bill, to recover of the insurance company upon two policies of insurance upon the life of John H. Potter, issued to him on August 6, 1931; or the company is entitled, under its original bill, to have said policies declared void and canceled for fraudulent representations or concealments alleged to have been made by John H.
