MEMORANDUM OPINION AND ORDER'

ZATKOFF, District Judge.

This matter is before the Court on defendant, Wausau Insurance Company’s, motion for rehearing. Pursuant to a Memorandum Opinion and Order dated August 13, 1990, 742 F.Supp. 1342, this Court denied defendant’s motion for summary judgment and granted plaintiff’s motion for summary judgment. Defendant timely filed this motion for rehearing consistent with this court’s local rule 17(m), as well as Fed.R.Civ.P. 52(b), 59 and 60. This suit was brought to obtain no-fault benefits.
