ORDER DENYING REHEARING

THOMAS C. BRITTON, Chief Judge.

The debtor’s timely motion for rehearing (C.P. No. 84) addressed to the January 20 Order Denying Confirmation and Dismissing Case (C.P. No. 81) was heard February 10. The motion is denied.

Movant argues that two ballots from parties who had not filed proofs of claim should have been counted because the debtor now wishes to withdraw its denial of those claims. The creditor election on this plan was held December 2, the date set for the confirmation hearing and the deadline set for the filing of creditor acceptances and rejections. The…
