OPINION FINDINGS OF FACT AND CONCLUSIONS OF LAW

LEYET, District Judge.

This is the story of “The Lord Amherst,” a Stradivarius violin once owned and played by Fritz Kreisler. 1 Dr. Ber nard Mortimer, a physician, a music lover, although not a musician, bought the violin in 1958, paying $20,000 for it, loaned it to Benno Rabinof, a concert violinist, to play. Later, Mortimer became involved with the Internal Revenue Service of the United States of America in respect to income taxes and the government levied a tax lien against The Lord Amherst.
