This is an action of contract brought in the Superior Court upon a bond given by the defendant pursuant to G. L. (Ter. Ed.) c. 239, § 5 (relating to the giving of bond by a defendant appealing from a judgment of a District Court upon summary process for the possession of *714land), by which action the plaintiff seeks to recover the rent due at the time of the surrender of possession of the tenement by the defendant, costs and other damages.
