Appeal from an order of the Court of Claims (Murray, J.), entered July 24, 1984, which granted the State’s motion to dismiss the claim.
Claimant was arrested in February 1977 pursuant to a superior court information charging him with criminal sale of a controlled substance in the third degree, then a class A-III felony* (Penal Law former § 220.39). Pursuant to a plea bargain agreement, claimant, represented by counsel, waived indictment and pleaded guilty as charged.
