— Appeal from an order of the Supreme Court at Special Term (Cholakis, J.), entered August 15, 1983 in Albany County, which granted defendant County of Albany’s motion to dismiss the complaint. 11 Pursuant to a warrant issued by the Town Court of Colonie, plaintiff was arrested on March 24,1981 and charged with the crime of forgery in the second degree. Subsequently, the charge was dropped when another individual was arrested and identified as the perpetrator of the charged crime.
