I. PROCEDURAL BACKGROUND

On October 15, 2001, the plaintiff in Case No. Ol-C-1137, Robert Tupper (“Tupper”), filed a complaint in the Milwaukee County Circuit Court. On November 7, 2001, the defendant, Bally Total Fitness Holding Corporation (“Bally”), removed the case to the United States District Court for the Eastern District of Wisconsin on the basis of diversity of citizenship, pursuant to 28 U.S.C. §§ 1332 and 1441.
