The plaintiff, Antonio P. Rosano, appeals from a final judgment dismissing his complaint against the defendants Mortgage Electronic Registration Systems, Inc. (MERS), EquiFirst Corporation (Equi-First), and Sutton Funding LLC c/o Ho-mEq Servicing (Sutton Funding) (collectively defendants). The plaintiff filed suit in the Superior Court seeking a declaratory judgment and injunctive relief preventing the foreclosure sale of his mortgaged property, arguing that the assignment of his mortgage through MERS was a legal nullity.
