BLAIR, Justice.
Cause No. 9324, Railroad Commission v. Magnolia Petroleum Company, and cause *254No. 9325, Railroad Commission v. Magnolia Petroleum Company are Rule 37 cases, which involve two separate tracts of land, but present entirely similar facts and are controlled by the same principles of law. They were briefed and presented in this court together, and this opinion will be filed in and will dispose of each case.
