MEMORANDUM
JOHN GARRETT PENN, District Judge.
This ease is before the Court on cross-motions for summary judgment. After carefully considering the motions, the opposition to them, the oral arguments of the parties, and the record in this case, the Court concludes that plaintiffs second motion for summary judgment should be denied, and that DoD’s motion for summary judgment should be granted.
