Guarriello v. SUNSTATE EQUIPMENT CORP.
Court of Appeals of Arizona
1Opinion of the Court
OPINION
HATHAWAY, Judge.
Sunstate appeals the granting of summary judgment in favor of appellees Donna and Andrew Guarriello (Guarriello) concerning the mechanic’s lien Sunstate filed against their real property, which we affirm. Guarriello cross-appeals the trial court’s denial of additional damages pursuant to AR.S. § 33-420(C), which we reverse.
Summary judgment is appropriate when no material facts are disputed and the moving party is entitled to judgment as a matter of law. Gulf Ins. Co. v. Grisham, 126 Ariz. 123, 124, 613 P.2d 283, 284 (1980).
