McWILLIAMS, Circuit Judge.
This 10b-5 securities case has been in this court three times. Initially, the federal district court denied the defendants’ request that plaintiffs federal securities claim be submitted to arbitration. At the same time the federal district court dismissed the plaintiff’s pendent state claims. See Coffey v. Dean Witter Reynolds Inc., et al., 640 F.Supp. 874 (D.C.Colo.1986).
