Appeal by Appeal bydefendant, as limited by his motion, from a sentence of the Supreme Court, Kings County, imposed May 4, 1976, upon his conviction of petit larceny, upon his plea of guilty, the sentence being a term of imprisonment of one year. Sentence modified, as a matter of discretion in the interest of justice, by reducing it to a three-year period of probation and case remitted to the Criminal Term to fix the conditions of probation and for further proceedings pursuant to CPL 460.50 (subd 5).
