WATHEN, Chief Justice.

[¶ 1] Defendant Daniel Knowlton appeals from a judgment entered in the Superior Court (Androscoggin, Delahanty, J.) granting plaintiffs’ motion for judgment as a matter of law and setting aside a jury verdict for defendant pursuant to M.R.Civ.P. 50(b). On appeal, defendant contends that the court erred in ruling that his conduct constituted negligence as a matter of law. We agree. Accordingly, we vacate the judgment and remand with instructions to enter judgment on the jury verdict.
