In this opinion we will refer to the parties as they appeared in the trial court; that is, respondent as plaintiff and petitioner as defendant.

Plaintiff, James M. Stuart, Jr., recovered a judgment for personal injuries against defendant, J. B. Blood-*569worth, doing business as Bloodworth. Construction Company, iix the ■ Circuit Court of Davidson County. Defendant appealed to the Court of-Appeals. That Court affirmed'the judgment. We granted certiorari.
