This case was before this court on a former appeal from a judgment in favor of the respondent, and the judgment was reversed for errors committed on the trial, and a new trial was ordered. See 60 Wis. 141. The nature *8of the action is fully stated in the reported case, and need not be restated here. The case has been re-tried, and it is again brought here by an appeal by the defendant.
