This case is before the Court upon the appeal of Thompson Development, Inc. (hereinafter referred to as Thompson) from final orders dated January 9, 1989, 1 and August 6, 1990, entered in the Circuit Court of Harrison County which granted summary judgment in favor of the appel-lee, The Kroger Company (hereinafter referred to as Kroger).
