The City of Eagle Pass brought this suit in the district court of Maverick county, Tex., against the Galveston, Harrisburg & San Antonio Railway Company ; the purpose being to require the railway company to open a part of what is alleged to be Main street of the city of Eagle Pass, and to remove therefrom a portion of a freight depot, said depot being located partly in what is claimed to be a projection of Main street across the railway company’s property.
