ORDER AND REASONS

JANE TRICHE MILAZZO, District Judge.

Plaintiff Pierre Biel filed a petition in this Court under the Hague Convention on the Civil Aspects of International Child Abduction (the “Hague Convention”), T.I.A.S. No. 11760, 19 I.L.M. 1501, seeking the return of his son to Luxembourg. Upon learning of an ongoing custody proceeding, the Court raised the issue of abstention sua sponte.1 Having reviewed the state court proceedings, the arguments of counsel, and the applicable law, the Court finds abstention inappropriate in this case. *634Accordingly, the Court will adjudicate the petition.
