GOODRICH, Circuit Judge.
This case involves the applicability to the plaintiff of the Federal Employers’ Liability Act, 45 U.S.C.A. § 51. 1 The issue is accurately stated in a stipulation worked out between counsel for the litigants at a pre-trial conference. It is as follows: “It is agreed that an issue to be decided by the Court is whether or not the plaintiff was engaged in interstate commerce while working for the Monessen Southwestern Railway Company, a common carrier, or was -engaged as an employee of the Pittsburgh Steel Company in their open hearth department.” This is the sole issue…
