NOEL, District Judge.

This case was removed here from the 125th District Court of Harris County, Texas. Plaintiff in the removed cause of action is movant here, having filed herein his motion to remand his cause of action to the state eourt. No hearing has been had on the motion. The statements of fact made herein are based on the pleadings and briefs of the parties.
