The plaintiffs, George G. Stillman and Lily Stillman, were the owners of a 480-acre farm situated near the town of Slifer, in Webster county, Iowa. This farm was incumbered by three mortgages. The first and second mortgages were in favor of the defendant Slifer Savings Bank, of which the defendant Oscar Madson was the cashier, and the third mortgage was in favor of the defendant Harry J.
