In the spring of 1871 the board of directors of the L. B. & M. R. R. Co., of which William H. Pells was then a member, let to appellees’ firm the contract for the construction of its road, which was to extend from Bloomington east to the State line, at a specified price per mile. By the terms of the contract, Snell, Taylor & Co. were given the right to locate the stations east of McLean county, with the consent of the chief engineer of the T. W. & W. R. R.
