¶ 1 In a protracted probate proceeding during which the value of the estate significantly increases, does the probate court's equitable power include making a compensatory increase to the surviving spouse's elective share? Addressing a question of first impression in Colorado, we conclude that the probate court erred in making such an equitable adjustment, which is the primary issue in this appeal.
