In connection with its construction contract with the County of Oneida to build the Oneida County Office Building in Utica, New York, on May 13, 1968 Vincent J. Smith, Inc. (Smith) entered into two subcontracts with Skyway Roofing Company, Inc. (Skyway Roofing). Louis J. Colangione and Louis R.
