The driving privileges of defendant, Thomas J. Brown, were summarily suspended when, after his arrest for driving while under the influence of alcohol (DUI) (625 ILCS 5/11 — 501(a)(2) (West 2004)), he refused to submit to chemical testing to determine his blood-alcohol concentration. Defendant petitioned to rescind the suspension, subsequently moved to voluntarily dismiss that petition, and requested leave to file a motion to quash his arrest and suppress the evidence seized.
