Defendant in error, Robert Graham, brought suit in the circuit court of Cook county against the plaintiff in error, Charles .E. Hagmann, for personal injuries received as the result of a .collision between the wagon in which he was riding and the automobile of plaintiff in error. The accident occurred about eleven o’clock on the night of June 24, 1911, at the intersection of Jackson boulevard and Homan avenue, in the city of Chicago.
