I. Background

This action was brought pursuant to Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e, et seq, as amended. Plaintiff Gani-yu Jaiyeola (“Jaiyeola”) alleges that he received negative performance evaluations and was terminated from employment with Defendant Carrier Corporation (“Carrier”) based on his race, color, and national origin.
