Jimmy R. Smart appeals his convictice. sentence for the October 27, 2000, capital murder of Manila resident C.B. Murphy. Smart raises three arguments, none of which has merit.
Smart’s first argument on appeal is that the trial court erred in denying his motion to suppress the statement he gave to police officers. Although Smart does not contend the evidence was insufficient to support his conviction, we must first briefly discuss the facts leading to his arrest and the statement.
