GRAVES, Judge.

Appellant was charged with the offense of burglary of a private residence at nighttime, and was by the jury assessed a penalty of twenty years in the penitentiary, hence this appeal.

It appears from the facts that Mr. Sample and his wife lived in Longview, Texas, and while away on a summer trip to California they left a negro by the name of Henry Johnson in charge of their home. Johnson slept in a room over their garage, but had a key to the home, and went in there and cooked his meals in the kitchen. He had been working for them, for many years. He cleaned the house, and…
