This suit was brought by appellant Miller for a mandamus to compel appellee Smiley, the superintendent of public schools for Harris county to approve a contract of employment made by the trustees of common school district No. 36 with appellant as teacher of history in the Almeda High School in said district for the present term of said school. The petition also asked for temporary injunction protecting plaintiff's contract rights pending a final hearing of her suit for mandamus. This appeal is from an order of the trial court refusing the temporary injunction.
