SMITH, Senior Judge.
This ease is one of the last Winstar-related cases before the Court, the background of which is well described in United States v. Winstar Corp., 518 U.S. 839, 116 S.Ct. 2432, 135 L.Ed.2d 964 (1996). For the reasons set forth in the Court’s previous opinion in this matter, Defendant is liable for its breach of contract with Plaintiffs in connection with the elimination of supervisory goodwill as a component of regulatory capital.
