This case was commenced when fifty-three residents and property owners in the City of States boro filed a petition with the mayor and council of that city requesting that that body make an immediate investigation to determine the safety of the storage of material used by the defendant Southeastern Liquid Fertilizer Co., and requesting the council to cause the same to be moved to another location if such material were found to be dangerous to life and property.
