This is an action for declaratory relief and damages alleging violations of the Employee Retirement Income Security Act (“ERISA”), 29 U.S.C. § 1001 et seq. Plaintiffs allege that Defendant American Telegraph & Telephone Company (“AT & T”), in its administration of the AT & T Management Pension Plan (the “Plan”), discriminates against its employees on the basis of marital status and sexual orientation in determining beneficiary eligibility for Sickness Death Benefits under the Plan.
