Error to Court of Civil Appeals of Second Supreme Judicial District. Action by W. E. Hartt against the Tturia Cattle Company and others. Prom judgment for defendants, plaintiff appealed to the Court of Civil Appeals, which affirmed (210 S. W. 612), and plaintiff brings error.

This is an action in damages, instituted in the district court of Tar-rant county, Tex., by W. E. Hartt against the Tturia Cattle Company, the George R. Barse Live Stock Commission Company, and A. Cohn. The action is based upon the breach of an alleged contract of guaranty as well as alleged false and fraudulent representations made by Cohn to the agents of Hartt in the sale of certain cattle.
