In this case there are the same procedural defects that were dealt with in Milwaukee County v. Industrial Comm. (1938), 228 Wis. 94, 279 N. W. 655. For the reasons stated there the circuit court had jurisdiction to review the record made before the Industrial Commission. In that case the appeal was taken by the Industrial Commission and the appeal was dismissed for the reason there stated, the Industrial Commission not being a party under the statute.
