The appellant Bonnie Lutz brought this action in the United States District Court for the District of Colorado claiming she was constructively discharged from her position as a tenured teacher with the defendant-appellee Weld County School District No. 6 because of her handicap, partial hearing loss, in violation of § 504 of the Rehabilitation Act of 1973, 87 Stat. 394 codified at 29 U.S.C. § 794, the equal protection clause of the Fourteenth Amendment to the Constitution of the United States, and 42 U.S.C. § 1983.
