In an action to recover money damages under Banking Law § 108 and General Obligations Law § 5-511, and for breach of contract, the plaintiff appeals (1) from an order of the Supreme Court, Nassau County (Brucia, J.), dated February 26, 1988, which denied its motion for summary judgment with respect to its first cause of action and granted the defendant’s cross motion for partial summary judgment dismissing that cause of action, and (2) as limited by its brief, from so much of an order of the same court, dated June 28, 1988, as, upon reargument, adhered to the original determination.
