In an action commenced in tlie district court of Douglas county to foreclose a mortgage the case proceeded to decree of foreclosure, to enforce which an order of sale issued, sale was made, and a motion to confirm it filed. At this stage of the proceedings a motion to set aside the sale was presented on behalf of the principal defendants, the ground of the motion being that the appraisement of the property made and returned as a part of a complete and perfect judicial sale was too low.
