FOSTER, Justice.

Appellant is a foreign corporation organized under the laws of Delaware.

On June 28, 1940, the State Department of Revenue made an assessment of the franchise tax against it. On July 13, 1940, appellant undertook to appeal to the Circuit Court of Jefferson County, in equity. That court sustained a motion to dismiss the appeal, and dismissed it on the gound that being a foreign corporation, under the laws pertaining to appeals under such circumstances, it should have been to the Circuit Court of Montgomery County, in equity.
