after making the foregoing statement, delivered the opinion of the court.
The question to be considered here is whether the city of Chicago became liable for the use and occupation of appellant’s premises by the State troops. The Circuit Court held that the city did not use or occupy the park; that, inasmuch as the statute provides that the mayor shall have power to call out the National Guard “ to aid in suppressing riots and other disorderly conduct * * * subject to the authority of the governor as commander in chief of the militia,” the mayor’s authority ceased when the…
