ORDER

McCUSKEY, District Judge.

On May 18, 1998, Plaintiff, Independent Lift Truck Builders Union, filed a Complaint (# 1) against Defendant, NACCO Materials Handling Group, Inc. Plaintiff sought an Order compelling Defendant to submit a grievance to arbitration. Defendant filed a Motion for Summary Judgment (#9) arguing that the issue Plaintiff sought to arbitrate was already decided by an arbitrator on May 10, 1993.
