This ease is before us on petition for review granted on August 30, 1951, pursuant to the provisions of the Uniform Code of Military Justice, Article 67(b) (3) (Act of 5 May 1950, 64 Stat. 108; 50 U.S.C. §§ 551-736). The accused, a corporal in the 622nd Military Police Company, stationed in Korea, was charged with rape in violation of Article of War 92 (§1, Chap.
