OPINION
OVARD, Justice.
We overrule both LSR’s and Callewart’s motions for rehearing. We withdraw our opinion of January 16,1992, and vacate our judgment of that date. This is now the Court’s opinion.
This is a fraud and Deceptive Trade Practices-Consumer Protection Act (DTPA) case concerning the purchase of a building. Dr. Robert A. Callewart originally sued Thomas C. Brandenburg, Peter A.
